Privacy Policy for nitenoon.pl
This Privacy Policy (“Policy”) sets out the rules for using the nitenoon.pl website and is intended to present the most important information on how personal data is used in light of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”).
1. General Remarks and Controller’s Details
1.1. Personal data that may be processed under this Policy are information relating to a natural person that allow that person to be identified by reference to one or more factors specific to their physical, economic, or cultural identity, including the device IP address, location data, online identifier, and information collected via Cookies and other similar technologies.
1.2. The main personal data processed by the Controller include: the user’s first and last name, email address, phone number, and residential or correspondence address.

Nowogrodzka 64/43, 02-014 Warszawa, REGON: 529642594 (“Controller”), represented by Katarzyna Hetmańska (Management Board Member) and Marek Horczewski (Management Board Member).
2. Purposes and Legal Bases for Processing Personal Data
2.1. The Controller processes personal data on the basis of:
- necessity for the performance of a sales contract for products (Article 6(1)(b) GDPR),
- the user’s voluntary consent (Article 6(1)(a) GDPR),
- the Controller’s legitimate interests (Article 6(1)(f) GDPR).
2.2. The Controller processes personal data solely for the purpose of:
- making content available on the nitenoon.pl website,
- providing electronic services, including, in particular, direct marketing of the Controller’s own products (e.g., in the form of a newsletter – if such an option is offered by the Controller),
- concluding sales contracts and handling inquiries, returns, complaints, etc.
2.3. Personal data may also be processed for analytical and statistical purposes (conducting analyses of users’ activity and preferences). In some cases, the Controller uses profiling. Through automated processing, the Controller assesses selected information regarding natural persons to analyze their behavior or create a forecast of their future behavior.
2.4. Data may be transferred to entities processing them on behalf of the Controller under agreements concluded with the Controller, but only for the purpose and to the extent necessary to achieve the above objectives, including entities providing IT services or other services ensuring the proper functioning of the website for the Controller, provided that such entities process data solely in accordance with the Controller’s instructions.
2.5. Users’ personal data may be transferred to entities in third countries located outside the European Economic Area which, however, ensure an adequate level of personal data protection in their territory.
2.6. Providing accurate personal data by the user is a condition for concluding a sales contract for the offered products, under which the user is the purchaser.
3. Personal Data Retention Period
3.1. The Controller processes personal data only for the period necessary to fulfill the purpose of their storage or for as long as required of the Controller by law, in particular until the limitation period for potential claims or the expiry of archiving obligations arising from legal provisions, including the obligation to store accounting documents.
3.2. If personal data are processed for the purpose of providing a newsletter service, the data will be processed for the period necessary to provide that service until the user unsubscribes.
3.3. If personal data are processed on the basis of consent, the data will be stored until that consent is withdrawn. Consents given on the website, including consent to processing for marketing purposes by entities cooperating with the Controller, may be withdrawn at any time. Withdrawal of consent will not affect the lawfulness of processing carried out before its withdrawal.
3.4. If data are processed on the basis of the Controller’s legitimate interest, the Controller will cease processing earlier if the user effectively objects to the processing.
4. User Rights
4.1. The user has the right to:
- access their data,
- obtain a copy of their data,
- rectification, erasure, or restriction of processing,
- data portability,
- object to processing,
- withdraw consent,
- lodge a complaint with the President of the Personal Data Protection Office (UODO).
4.2. The rules for exercising the above rights are described in detail in particular in Articles 16–22 GDPR. The user may always contact the Controller to request information about the data held and the purposes for which they are processed.
5. Cookies
5.1. Cookies are small text files that are stored on a device when using the nitenoon.pl website. These files are sent by the website to the browser. Each cookie has an anonymous identifier and enables identification of the device in which it is stored for a specified time (after which the given cookie will be deleted). Cookies are stored to recognize the device, learn preferences, and collect information about previous actions on the website.

* Functional cookies – store information about choices, enabling improved and personalized features. For example, such cookies may store information about tracking numbers entered in applications. 6.2. By doing so, the user provides the Controller in particular with such data as first and last name and email address. Other personal data may be provided to the Controller on an optional basis.
6.3. The legal basis for processing personal data in this case is the user’s consent resulting from initiating contact with the Controller. Personal data sent as part of email contact are processed solely for the purpose of handling the inquiry. Correspondence is stored on the mailbox server and may be archived.
7. Changes to the Policy
7.1. To ensure that the Policy continuously meets current legal requirements, the Controller reserves the right to amend it at any time.
7.2. The above also applies where the Policy requires amendments in order to cover new or modified products or services of the website.
